We have all watched enough TV over our lives to recognise the phrase that generally begins with... "You have the right to remain silent, anything you say can, and may, be used in a Court against you..." - and, although we have heard it many times watching TV, it's quite a different matter when we hear it first hand from an arresting Police Officer.
The thing is, the phrase is true, and it's there to protect you, and as such, you should use it for your own benefit, event if you know you are innocent.
You won't get yourself into any worse of a situation by saying nothing, but you can talk your way into a whole lot of trouble....
If you are questioned, detained or arrested by the Police, your legal rights are:
- You have the right to consult and instruct a lawyer, in private, and without delay.
- You have the right to refrain from making a statement.
- You have the right to ask why you are being questioned, detained, or arrested.
YOU SHOULD CALL A LAWYER BEFORE YOU SAY ANYTHING TO THE POLICE.
The job of any criminal lawyer is to get the best outcome for you, whether it be pleading guilty and mitigating the ultimate outcome, or vigorously defending the charge to the full extent of the law.
If you find yourself in a situation with the Police - SAY NOTHING, and call me.
